I take the point, and reveal the limit of my knowledge about US domestic affairs to boot. All I can really offer in response is a question: is it possible that some of the administration's actions in this regard might have been futile attempts to build some sort of rapport with whatever constitutes the moderate end of the Republican party in Congress, rather than Obama's actual views? Once he's no longer constrained by the need to follow through on his promise as president to work on a more bipartisan approach to politics, is it possible he'll just say, "Screw those guys," and act more in line with civil liberty principles?
And if the answer to those two questions is, "No," should someone point it out to the more libertarian Republicans who might then be persuaded to help get approval for Obama's nominee, rather than risking the man himself getting in? ;)
